We conducted several work sessions to fully understand the issues. Faced with the particularity of the company, we organized and led working sessions with a specialist in the specific field of the company in order to validate certain hypotheses, revise the valuations of the assets made by the approved appraisers in order to establish the value of the company by using different methods to determine the basis of our claims.

The client also had to find a new accounting firm to avoid a conflict of interest with the accounting firm of the operating company. We then suggested various alternatives to him and we then set up, with the team of accountants he had chosen, his new corporate structure. Not having a lawyer in its team of professionals, we then integrated into our discussions one of our external resources to set up, present and negotiate the settlement. After a year of almost weekly support, we obtained the desired settlement and finalized the transaction.

A profitable and optimized payout

We had structured the settlement to maximize each tax dollar because we had an overall picture of the client. Capital gains exemption at the personal level, creation of management company, RRSP arrears, dividend payment to recover the RDTOH, TFSA, etc. We then opened all the investment accounts accordingly, integrating the reality of his spouse into the equation.
